Dr. H. Richard Marshall, Jr. has been appointed by Governor Manchin to a five year term on the Board of Dental Examiners. He is a general dentist practicing in Ronceverte, West Virginia. His term expires June 30, 2010.

IMPORTANT NOTICE CONCERNING
HAND AND/OR WRIST X-RAYSThis notice is given by the West Virginia Board of Dental Examiners to instruct dentists who may be allowing dental auxiliary personnel to take hand and/or wrist x-rays to evaluate growing patients to cease and desist the delegation of this practice.
While dentists are exempt from having to obtain a radiologic license to take such x-rays, dental auxiliary are exempt only from those x-rays confined to the area comprising the oral cavity, maxillofacial area and the adjacent and associated structures. Therefore, dental auxiliaries would need to be licensed by the Radiologic Board to perform such duties.

MASS CASUALTY EVENT & EMERGENCY
CARE BEYOND THE HEAD AND NECK
Information has been requested on several occasions concerning the administration of vaccinations in the event of a mass emergency event in the State of West Virginia. The Board is unaware of any law that allows a dentist to administer vaccinations in an emergency situation and the same is not within the scope of practice of a dentist.
However, §30-3-13(b)(5) allows any person to administer first aid in emergency situations.

All of the course guidelines for expanded duties for assistants and hygienists have been posted on the Board’s web site. Let us remind you the Board only approves courses in accordance with the guidelines. The Board does not give the courses.
HAVE YOU MOVED??
The Rules of the West Virginia Board of Dental Examiners, 5CSR 1 Section 12.3, requires you to report a change in your home or office address or the reporting of additional office addresses to the Board within 30 days.
These changes may be reported by mail, email and/or fax.

Before you perform those Duties...
Be sure you have secured the necessary certificate to do those expanded duties that require a board approved course and/or testing. Completion of a board approved course and/or testing does not authorize you to practice these privileges until your application is completed and a certificate is received from the Board office.
Should you be performing these duties without a certificate generated by the Board of Dental Examiners, you are in violation of the law.
CPR REQUIREMENTS
The required CPR course for nitrous oxide monitoring is the Healthcare Provider CPR course. There are various courses for CPR. Please be sure to take the correct course.

Dr. Stephen A. Davis - Consent Decree - Violation of the law by allowing his dental assistant to administer nitrous oxide. Fine $1,000 and Assessed Costs of $500.
Dr. Quincy B. Gilliam - Revoked - License Suspended in another State for violations which are punishable by the West Virginia Dental Practice Act.
Dr. Thomas H. Greene - Consent Decree - Violation of the law by failing to meet the acceptable standards of care. Fine $500 and Assessed Costs of $600.

POSITION STATEMENT
CONCERNING ORAQIX
The West Virginia Board of Dental Examiners has amended its position statement concerning the administration of Oraqix by a dental hygienist in the State of West Virginia.
In the State of West Virginia the administration of Oraqix by a dental hygienist does not require a certificate to administer local anesthesia.
CONTINUING EDUCATION AUDITS
The Board would like to thank those randomly audited for the period of February 1, 2002 through January 31, 2004 for their kind cooperation.
Be reminded that continuing education certificates should be received within a reasonable time from the course provider and maintained by the licensee for a period of 6 years. When you are audited by the Board you should not have to call around to get your certificates. You should already have them! It is your license and your responsibility to conform to the continuing education rules in order to renew.
IMPORTANT INFORMATION FROM THE
WV BOARD OF PHARMACY
CLARIFICATION OF SCHEDULE II
PRESCRIPTION WRITING
“No prescription for a controlled substance in Schedule II may be refilled.” 21 U.S.C. 829(a). “For a physician to prepare multiple prescriptions on the same day with instructions to fill on different dates is tantamount to writing a prescription authorizing refills of a Schedule II controlled substance. To do so conflicts with one of the fundamental purposes of section 829(a).”
Therefore, according to DEA officials prescribers may no longer write multiple Schedule II prescriptions on the same day with instructions to fill at a later date and dispensers may no longer accept such prescriptions. If a patient presents multiple scripts dated the same day, then the pharmacist would have the knowledge that this has been done and should inform the patient they cannot fill the subsequent scripts and the patient needs to contact their doctor to reissue a new script at a later date. If only one prescription is presented with a notation that it should not be filled until a later date and that is within 90 days of the date issued, then a pharmacist may fill the prescription.
This “clarification” by the DEA will actually cause a lot of confusion until prescribers are aware of the limitations. It will also create a hardship for some patients for whom such a mechanism of prescribing served their legitimate needs and posed no risk of diversion or abuse.
The information was sent to licensing boards of the prescribers so licensees can be informed. Although this is a federal regulation, it will be enforced by both federal and state enforcement personnel.
NEW CONTINUING EDUCATION
REQUIREMENTS
The Board has promulgated new rules concerning continuing education credits. For the period of February 1, 2006 through January 31, 2008 a dentist will be required to complete 35 hours and a hygienist 20 hours of continuing education credits.
Of those hours you are required to have a current certification of at least a healthcare provider CPR/BLS course recognized by the American Heart Association or American Red Cross and will be counted towards your CE credits.
At least two hours shall be related to any one or combination of the following subjects: Infection Control and/or occupational hazards, oral effects of tobacco use or substance abuse.
You can obtain credits for serving on a dental or hygiene committee and indigent patient care. The amount can not exceed 5 hours for dentist or hygienists for committees. For indigent care the amount can not exceed 5 hours for dentists and 3 hours for hygienists.
